-what rights do tenants have in the case of a foreclosed or short sale property. As foreclosures claim more casualties, tenants living in foreclosed properties may no longer be among the victims. The Protecting Tenants at Foreclosurers Act, effective May 20, 2009, requires the purchasers of a property at a foreclosure sale – most often a foreclosing lender – to give a “ bona fide tenant “ at least 90 days notice to vacate the property.
